Terms of business:

 

1. Acceptance of your order 

 

a. I will provide you with a Total Estimated Cost for making your Item/s, based on fabric chosen by you. Once you have agreed the estimate, signed and paid your part-payment, we will have a mutually binding contract for me to order materials and make your Item and for you to pay me for my work.  The Estimated Cost is valid for 90 days from the date of the estimate.  

 

b. If you require assistance in the design phase, such as advice on and sourcing of fabrics in advance of placing an order, an initial deposit of £50 will be required which will be set against the cost of your order once accepted by you.  If you choose not to proceed with the order, this deposit will be retained by me as consideration for the work undertaken.

 

c. If for any reason you change your mind or are unable to proceed with the contract, depending on how much work has been undertaken and/or materials ordered or used in reliance on your commission, I will use my reasonable discretion and may agree cancellation terms with you.   I will advise you if it is too late to cancel.  If the Item/s has/have been completed, you must pay me the balance of the Total Estimated Cost.

 

c. If unforeseen circumstances arise after you place your order which mean that I will have to cancel or significantly reschedule your order, I will notify you as soon as possible.  If I have to cancel your order after your part-payment has been paid, I will give you a full refund of your part-payment.

 

d. Returns: Curtains and blinds are made to your individual requirements. I will not accept returns and no refund will be given if you change your mind after delivery.

 

e. The work will be undertaken on an ‘as-measured’ basis.  Please note that if, for any reason, you choose to replace the track and/or poles and have not notified me in advance of making, the work may not fit.

 

f. The Estimated Cost does not include delivery and fitting.

 

 

2. Payment

 

You agree to pay a part-payment of 50% of the Total Estimated Cost on signature of this Commission.  The Balance will be payable before delivery of the Item/s, and will be adjusted to take account of the actual cost incurred of any materials (heading tape, sewing thread, hooks) used to complete the Item/s to your specification.  You will be given a complete breakdown of the actual costs.  Please do not ask for credit terms.  

 

3. Date of completion

 

(a) The Estimated date of completion may be subject to change due to any unforeseen circumstances.  The Estimated date of commencement will depend on date of confirmation of the order and will be subject to other work already scheduled.  I will keep you informed and will advise you of any change.  If necessary, I will give you a new estimated date of completion.

 

4. Risk 

 

Any Risk in the Item/s including loss or damage will remain with me until I deliver the Item/s to you.  When delivered all risk immediately transfers to you.

 

‘Delivery’ means transferring ownership of items made from me to you.  It does not mean delivery to your home unless otherwise agreed in advance and added to the Estimated Cost.

 

5. Acceptance of your Item

 

If you find any issues with the work undertaken on your Item/s, you must let me know within one (1) month of delivery.  I will inspect your Item/s and, if it is faulty, may agree to repair or replace your Item/s as appropriate, or as we may mutually agree.  Creasing is not a fault.  One (1) month after delivery, your Item/s will be deemed accepted by you.  If you find any issue with the workmanship on your Item/s after one (1) month, please let me know and we may agree an appropriate fee for any remedial work required.

 

6. Care of your Item

 

I want all customers to be happy.  The bespoke items are made for you for normal foreseeable domestic use only.  If any fault arises which I deem due to your failure to reasonably look after your Item/s, I will undertake remedial work only on terms which we may mutually agree.  

 

7. Supply of fabric

 

If you are supplying your own fabric to me to work with, you accept responsibility for the quality of that fabric.  I will use my best endeavours to produce your Item/s to the high standard item you expect.  I cannot accept responsibility for fabric which may have flaws in the finish or the printing.  Reputable curtain fabric suppliers will indicate any flaws with supplier’s ‘tags’ at the selvedge of the fabric.  We can discuss these prior to work commencing.

 

8. Measuring

 

Measurements taken by you and supplied to me will be your own responsibility. 

 

Where I undertake to make Item/s to your own sizes, you must give me the sizes in writing and the instruction must say the exact finished size required.  In the event of an under-measure, I will only remake on the understanding that it will be a new contract.

 

9. Fitting

 

The Estimated Cost does not include Fitting.  I do not take responsibility for fitting your curtains or blinds.  I am happy to recommend a qualified fitter to you.  Your contract will be direct with the fitter.

 

11. Force Majeure 

 

I will not be held responsible for any delays or failures to meet our obligations where it is beyond my reasonable control. 

 

12. Jurisdiction and Governing Law

 

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts in the event of any dispute arising from these terms and conditions.
